Terms and Conditions for Photo Booth Rental

Overview
These Terms and Conditions govern the rental of photo booth services provided by Booth co. ("we," "us," or "our"). By booking our services, you ("the renter") agree to abide by these Terms.

Booking and Deposits
To secure your reservation, a non-refundable deposit of 50% of the total package is required at the time of booking. The remaining balance must be paid in full no later than 2 days prior to the event. Failure to complete payment by this deadline may result in cancellation of your rental without refund of the deposit.

Rental Period
The rental period is defined in your booking confirmation and includes setup and breakdown time. Any extension of rental time requested on the event day will incur an additional charge, depending on the type of package selected.

Liability Waiver
Booth co. is not responsible for any injuries, damages, or losses occurring during the rental. The renter is responsible for providing a safe and suitable environment for the photo booth setup.

Damage and Repair Costs
The renter agrees to be liable for any damage to the photo booth or associated equipment caused during the rental period. In the case of such damage, the renter will be responsible for repair or replacement costs, which will be assessed at our discretion and deducted from the deposit or billed directly to the renter.

Intellectual Property Rights
All images captured by the photo booth during your event are the property of Booth co. We reserve the right to use, publish, or display these images for promotional purposes unless a written request to opt-out is made prior to the event.

Cancellations and Rescheduling
Cancellations must be submitted in writing at least 7 days prior to the event to avoid additional charges. Cancellations made after this period will result in forfeiture of the deposit. Rescheduling requests will be considered based on availability and must also be submitted in writing.

Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Namibia. Any disputes arising from these terms will be handled in the appropriate courts of Namibia.

Amendments
We reserve the right to modify these Terms and Conditions at any time. Any amendments will be posted on this page, and it is the renter's responsibility to review these terms before their event.

Additional Charges and Conditions:

1. Travel and Distance Fees:
   For events located 100 km or more outside Windhoek, we charge an additional fee based on the distance travelled at AA rates per km. This fee will be calculated and included in your final invoice.

1. Operational Hours and Accommodation Fees:
   If the booth is operational or expected to be operational after 21h00, additional accommodation fees will apply. These fees cover extended staffing, setup, and operational costs beyond normal hours.

Power Supply and Site Preparation:
The renter is responsible for providing a suitable power source within an appropriate distance unless otherwise arranged. The site must be clear of obstructions and ready for installation at the agreed setup time. Any special requirements for power, internet, or space should be communicated in advance.

Access and Setup:
Access to the event location must be arranged to allow for timely setup and breakdown. If access is restricted or difficult, the renter must inform us beforehand to make necessary arrangements. Any delays caused by access issues may incur additional charges.

​

Equipment Setup and Security:
Booth co. will handle the setup and takedown of equipment. The renter is responsible for ensuring the booth is secure and protected from theft or vandalism during the event. We are not responsible for any loss or theft of equipment or images after setup.

Data Privacy and Storage:
Images and data captured during the event will be stored securely. The renter can specify if they wish to receive copies of images or opt-out of promotional use. We retain the right to keep backups for a reasonable period unless otherwise instructed.

Technical Support:
Our team will be available for technical support during the rental period, but the renter should notify us beforehand of any special requirements.

​

Indemnity:
The renter agrees to indemnify and hold harmless Booth co. against any claims, damages, or liabilities arising from misuse, negligence, or failure to follow setup instructions.

​

Force Majeure:
Booth co. shall not be held liable for failure to perform due to circumstances beyond our control, such as natural disasters, government restrictions, or other force majeure events.

Acknowledgment
By making a booking with Booth co., you acknowledge that you have read, understood, and agree to these Terms and Conditions, including the additional charges outlined above.
